Notice of violation cites alleged NPDES stormwater permit failures in Pennsylvania
USA Environmental Solutions announced that a Notice of Violation has been issued alleging an industrial facility failed to comply with National Pollutant Discharge Elimination System (NPDES) stormwater discharge permit requirements in Pennsylvania.
According to the notice, the facility is alleged to have failed to implement required best management practices and to conduct mandated stormwater sampling. The Notice of Violation also states that the company may be subject to injunctive relief and potential civil penalties of up to $68,445 per violation per day, depending on the outcome of enforcement actions.
For stormwater professionals and regulated facilities, the alleged violations highlight common compliance gaps tied to operational controls and monitoring. USA Environmental Solutions noted that Pennsylvania businesses can reduce enforcement risk by routinely reviewing and updating Preparedness, Prevention, and Contingency Plans and Stormwater Pollution Prevention Plans, as well as ensuring BMPs are properly implemented and stormwater sampling is conducted on schedule.
Industrial stormwater permitting continues to be an enforcement priority, particularly where inadequate BMPs or missed sampling can lead to untreated discharges to surface waters.
