Virginia DEQ order addresses stormwater permitting violations at Carroll County site

The Virginia Department of Environmental Quality has issued an Order by Consent to Lineberrys Logistics LLC for stormwater permit violations at a Carroll County construction site, requiring corrective action and permit application.

The Virginia Department of Environmental Quality (VDEQ) and Lineberrys Logistics LLC have entered into a July 9 Order by Consent addressing alleged stormwater construction permitting violations at a site in Carroll County, Virginia.

According to the order, the site discharges to Little Cranberry Creek, a tributary of the New River. VDEQ alleges that Lineberrys Logistics failed to obtain coverage under Virginia’s general permit for stormwater discharges from construction activities.

The alleged violations also include failing to develop a Stormwater Pollution Prevention Plan (SWPPP), obtain an approved erosion and sediment control plan or agreement in lieu of a plan and properly install, implement or maintain required control measures.

Under the order’s compliance schedule, Lineberrys Logistics must develop and submit a Stormwater Management Plan, Erosion and Sediment Control Plan, SWPPP and Pollution Prevention Plan. The company must also apply for coverage under the construction stormwater permit.
